News :: DISMISSAL OF EMPLOYEES, 65 AND OVER

The Court of Appeal has granted employees who are 65 and over, the right to register their complaint for unfair dismissal and age discrimination at an employment tribunal, and to allow the claim to lie on file until the European Court of Justice has decided whether the right under UK law to dismiss an employee who is past retirement age is lawful.In practice this means that if you dismiss an employee who is 65 and over on the basis of their age then you are at risk of the employee bringing a claim.However, there should not be too long a wait for the answer, we will update you when the European Court have made their decision.
