The equality Act comes into force in October this year. Once the Act is in place employers will not be permitted to ask candidates pre-employment health questions. In limited circumstances questionnaires will be permitted, for example if a role requires physical fitness.
Law firm Pannone conducted a poll which revealed that over half of employers ask candidates pre-employment questions.
Employers are being advised to withdraw pre-employment health questionnaires in order to avoid disability discrimination when recruiting.
Employers however, can ask health questions after an offer of employment has been made.
